2. Introduction
Agreement Between Parties: This document constitutes an agreement between Champions Krav Maga Academy Pty Ltd ACN 660 436 582, situated at 889 Logan Road, Holland Park, QLD, 4121 (hereinafter referred to as "CKMA" or "the Academy"), and the undersigned participant (hereinafter referred to as "the Participant" or "I"). By signing this document, the Participant confirms their understanding and acceptance of the terms and conditions herein, which govern their membership and participation in the programs offered by the Academy.
Description of Services: CKMA provides training in Modern Krav Maga and integrated Mixed Martial Arts. The training encompasses group classes, private lessons, workshops, and related martial arts activities conducted at the academy’s facilities. The programs are designed to empower individuals by equipping them with self-defence skills and promoting physical fitness. The Academy's mission is to foster a safe, respectful, and result-oriented environment under the guidance of qualified instructors.
Acknowledgment: By signing this document, the Participant acknowledges that they have read, fully understood, and agreed to abide by the terms and conditions set forth, which are integral to the maintenance of safety, discipline, and the overall functioning of CKMA. The Participant also acknowledges that this document significantly impacts their legal rights and obligations.
3. Definitions
- Adult: A person over 18 years of age.
- Minor: A person under 18 years of age.
- Champions Krav Maga Academy/CKMA/the Academy: Champions Krav Maga Academy Pty Ltd ACN 660 436 582, which includes its heirs, estates, agents, representatives, officers, directors, shareholders, successors, affiliates, and employees.
- Law Enforcement and First Responder: A person who is a Police Officer, Paramedic, Fire Fighter, Correctional Officer, Border Force Officer, Emergency Nurse, or Transit Officer at the time of their membership application. Must show valid proof of employment.
- Participant, their, you, your, I: The person with an active membership at CKMA.
- Participation: The act of engaging in CKMA programs, attending classes, training sessions, events, or other activities as part of an active membership, adhering to CKMA's rules, guidelines, and instructions, and interacting with the CKMA community in accordance with the Terms and Conditions outlined in this document.
- Membership Application: The paper or electronic Membership Application form given to CKMA with relevant details (e.g., the person’s full name, address, and payment details).
Staff: directors, employees, consultants, independent contractors, or agents engaged by CKMA who work at the Academy.
- Terms and Conditions: The terms and conditions contained in this document.
- Veterans: A person who has served in the Australian Defence Force and New Zealand Defence Force. Must show valid proof of service.
- Guardian: A parent or other adult who has legal custody or guardianship over a Minor.
- Programs: The structured training and classes offered by CKMA including but not limited to Krav Maga, self-defence training, and any other martial arts or fitness programs provided.
- Instructors: Qualified individuals employed or contracted by CKMA to provide training and instruction in the Programs offered.
4. Waiver & Release of Liability
By participating in the activities and programs offered by CKMA, I, {name}, acknowledge and agree to the following:
1. Responsible Conduct:
- I agree to act responsibly with the techniques taught to me by CKMA. The techniques learned shall not be used outside of training, unless necessary and reasonable for my self-defence or the defence of another person.
2. Acknowledgement of Physical Demands:
- I understand and agree to participate in physically demanding activities that, if performed incorrectly, could be detrimental to my health.
3. Assumption of Risk:
- I understand and acknowledge that training at CKMA, despite being conducted in the safest possible conditions and under qualified supervision, inherently involves risks. These risks include physical contact and the potential for various accidents and/or injuries, which can range from minor (such as soft tissue injuries) to severe (including broken bones and joint injuries), and in rare instances, may lead to fatality. Recognising these risks, I willingly and voluntarily participate in these activities and accept full responsibility for any damages or personal injury that I may incur during my training at CKMA.
4. Indemnification:
- I agree to indemnify CKMA, its proprietors, agents, officers, including all instructors, staff members, and students against any loss or damage suffered in connection with my participation in the training.
5. Consent to Physical Contact:
- I acknowledge that physical contact will be used by instructors and other participants as part of martial arts training and give full consent to any physical contact required or customary to martial arts and self-defence training.
6. Health Declaration:
- I declare that I am physically capable of participating in self-defence and martial arts training, and have no existing medical condition, impairment, disease, or other illness that should reasonably preclude my participation.
7. Disclosure of Health Information:
- I agree to disclose any past injuries or current medical issues to CKMA. I understand that failure to inform CKMA of such conditions cannot hold CKMA liable for any complications that arise from training.
8. Compliance with CKMA Code of Conduct:
9. Safe and Appropriate Conduct:
- I agree to conduct myself in a safe and appropriate manner and will act in the best interests of CKMA.
10. COVID-19 Risk Acknowledgement:
- I understand that CKMA cannot guarantee my safety from becoming infected with COVID-19 through martial arts and self-defence training at the Academy premises and accept those risks.
11. Liability Release:
- I release CKMA, its proprietors, agents, and officers, including all instructors, staff members, and students from any liability whatsoever in connection with my participation in the physical activities and exercises within the CKMA training programs. Without limitation, this includes any loss or damage, or injury incurred as a direct or indirect result of my participation. I agree this release shall bind me, my spouse, my heirs, my personal representatives, my assigns, my children and my and their agents.
12. Media Consent:
- I consent to CKMA taking photographs and videos of classes for promotional use, waive any claims to ownership, revenue, or otherwise relating to the photographs and/or videos taken of me during class, and release and indemnify CKMA from any loss, damage, costs, expense, or claim, including defamation, libelous material, breach of privacy, or copyright.
13. Waiver of Claims:
- I agree that by consenting to these terms and conditions, I waive any cause of action or claim against CKMA, its proprietors, agents, officers, including all instructors, staff members, and students for any injuries that arise from my participation in any activities at CKMA.
14. Emergency Medical Treatment:
- In the event of an injury, accident, or illness occurring during participation in CKMA activities, I hereby grant permission for CKMA staff, who are trained in basic emergency response, to take necessary steps to seek emergency medical treatment. This may involve calling an ambulance or using first aid measures as required. For participants who are minors, this consent is given by the parent or legal guardian signing this agreement. It is understood that every effort will be made to contact the emergency contact provided in the case of such an emergency.
15. Equipment Usage:
- I agree to use and handle any equipment provided by CKMA for training purposes properly, and accept responsibility for any damage or loss of such equipment.
16. Personal Property:
- I understand that I am responsible for the security of my personal belongings brought into CKMA premises.
17. Venue's Rules and Regulations:
- I agree to adhere to all rules and regulations set forth by CKMA, and understand that failure to comply with the rules and regulations may result in termination of my membership.
18. Conflict Resolution:
- I agree to address any concerns or issues directly with CKMA management in a constructive and cooperative manner.
19. Parent/Guardian Consent (if applicable):
- If I am the parent or legal guardian of the participant, I consent to the minor’s participation and agree to the waiver and release of liability on behalf of the minor.
20. Applicable Law:
- I understand and agree that the laws of the state of Queensland, Australia, will govern this agreement.
5. Memberships
CKMA offers a variety of membership options to cater to the diverse needs of our participants. The membership types and terms are as follows:
1. Membership Types:
- Trial Memberships: Paid in full and strictly for new members only. Valid for the specified duration allocated on the membership application.
- Ongoing Memberships: These are recurring Month-to-Month Memberships based on a 28-day cycle. Payment frequency is determined by the choice made on your membership application, providing flexibility to suit individual financial preferences.
- Limited Duration Memberships: Paid in full and only valid for the specified duration allocated on the membership application.
- Discounted Memberships: CKMA provides a 20% discount on memberships for eligible Veterans, Law Enforcement, and First Responders as an expression of our appreciation for their service. In addition to our standard discounts, CKMA periodically introduces special offers and promotions specifically designed for new participants. While these special offers are primarily aimed at new participants, there may be occasions where current members can also take advantage of specific promotions. Eligibility for such promotions will be clearly stated in the offer details.
2. Membership Plans:
- Premium Month to Month Membership: Paid in weekly instalments, this membership plan grants you unlimited access to all our classes during operating hours.
- Basic Month to Month Membership: Paid in weekly instalments, this membership plan allows you to attend any two fixed days per week during operating hours.

Flexi-Month to Month Membership: Paid in monthly installments, this membership plan gives you access to 12 classes per month during operating hours.

10 Class Bundle Pack: This package offers a total of 10 classes with the freedom to attend at any time during operating hours, valid over a 3-month period.
3. Payment Details:
- All membership payments are to be made via direct debit, ensuring the required amount of funds is available on the due date.
4. Late Payment Fees:
- CKMA values timely payments to ensure the smooth operation of the academy and the provision of services to all participants. In the event that a membership payment is overdue, a late payment fee of $5 will be charged if the payment is not received within 3 days of the due date. Participants will receive a notification of overdue payment and are encouraged to settle their account promptly to avoid any additional fees and maintain uninterrupted access to CKMA programs and facilities.
5. Membership Fee Adjustments:
- CKMA reserves the right to adjust membership fees to reflect the economic conditions including, but not limited to, inflation and increased operational costs. Members will be notified of any fee adjustments with a notice period of 28 days prior to the new fees taking effect. Any fee adjustments are made at the sole discretion of CKMA to ensure the continued provision of high-quality services and facilities to all members.
6. Membership Renewal:
- Ongoing memberships are renewed automatically via a recurring direct debit unless otherwise specified in the chosen membership.
7. Membership Upgrades/Downgrades:
- Participants wishing to upgrade or downgrade their membership can do so at the end of their current monthly billing cycle. To facilitate this change, a minimum notice of 7 days prior to the end of the current billing cycle is required. Requests for membership changes must be submitted via email to admin@ckma.com.au. Upon receiving the request, CKMA will process the change to take effect from the start of the next billing cycle.
8. Member Communications:
- CKMA will communicate with members regarding their membership status, payment reminders, or any changes to membership terms via email, SMS, and in person as necessary.
9. Attendance Tracking:
- Instructors will manually check in each participant for class attendance.
10. Equipment:
- Participants are required to wear protective gear during sparring and drills, including a mouth guard, groin guard, shin guards, MMA gloves, and 12oz boxing gloves. Any failure to adhere to this equipment guideline may result in the participant being excluded from the activity for their safety and the safety of others.
6. Membership Freezes
In accordance with the CKMA Membership Freeze Policy, participants have the option to freeze their memberships under the following terms:
1. Eligibility:
- All membership types, except for Trial Memberships, are eligible for freezes.
2. Freeze Duration:
- Participants may choose from a 21 Day, 28 Day, or 56 Day Membership Freeze Request per calendar year, with a total cap of 56 days for membership freezes in a calendar year.

- During the freeze period, participants cannot attend any classes, and their membership payments must be current and up to date.
5. Resumption of Membership:
- After the membership freeze end date, memberships will automatically resume as normal. For Ongoing and Discounted Memberships, the membership will continue from where it left off. For Limited Duration Memberships, the end date will extend by the length of the freeze period.
6. Early Reactivation:
- Early reactivation is permissible at CKMA’s discretion and must be communicated via email.
7. Membership Fees:
- There are no fees associated with initiating a Membership Freeze. However, membership fees must be up-to-date to be eligible for a freeze.
8. Denial of Freeze Request:
- Membership Freeze Requests may be denied if membership fees are due.
By adhering to the Membership Freeze Policy, participants have the flexibility to manage their memberships in accordance with their personal circumstances while ensuring a continuous and structured training experience at CKMA.
7. Membership Cancellations
CKMA offers a range of membership options, each with specific terms and conditions. The following outlines the general procedure for cancelling any type of membership at CKMA:
1. Notice Requirement:
- To cancel your ongoing month-to-month membership, please submit a cancellation request at least 7 days before the start of your next month-to-month membership payment cycle. This notice period allows us to effectively manage class schedules and resources, ensuring a smooth transition for both you and the Academy.
2. Cancellation Process:
- Submit your membership cancellation request using our CKMA Membership Cancellation Request Form.
- Your regular membership payments will continue until the end of the current month-to-month membership cycle.
- Members are welcome to attend classes until the expiry of their month-to-month membership.
3. Cancellation Fees:
- No cancellation fees apply for Trial, Ongoing, and Discounted Memberships.
- A cancellation fee of $200 applies to Limited Duration Memberships if cancelled before their expiry date.
4. Outstanding Fees:
- Cancellation requests may be denied if membership fees are outstanding.
5. Refunds:
- No refund will be given on any unpaid usage left on any membership.
6. Attendance During Notice Period:
- Members can attend classes during their notice period.
7. Rejoining CKMA:
- Participants can rejoin CKMA after cancelling their membership. A $100 sign-up fee will apply, which may be waived at CKMA's discretion.
CKMA is dedicated to providing a clear and fair experience for all our members. Adhering to this cancellation policy ensures a respectful and orderly process for everyone involved.
8. Facilities and Services
CKMA offers a range of facilities and services designed to provide a comprehensive martial arts training experience. Below are the details regarding the availability and usage of these facilities and services:
1. Offerings:
- Group Classes, Private Lessons, Seminars, Workshops.
- Toilet facilities available on-site for participants.
2. Operating Hours:
- CKMA is open from 5:30 PM to 8:00 PM.
3. Usage Guidelines:
- Participants are expected to adhere to the CKMA Code of Conduct while using the facilities and engaging in services.
4. Special Events:
- Occasionally, special events may be held which could affect the availability of certain scheduled classes. Participants will be informed in advance.
5. Class Schedules:
- Class schedules are communicated through normal lines of communication and participants are advised to stay updated for any changes.
6. Guests:
- Participants may bring guests to spectate, under the participant’s sole responsibility. Participants are responsible for informing their guests of the inherent risks involved in observing martial arts training and ensuring their guests adhere to CKMA’s safety guidelines and Code of Conduct at all times while on the premises. Guests must not disrupt the class, and CKMA shall not be liable for any injuries, damages, or losses sustained by guests while on the premises.
7. Unforeseen Circumstances:
- In cases of unforeseen circumstances such as instructor unavailability, participants will be informed about class cancellations or schedule changes via email or SMS.
8. Alterations and Adjustments:
- CKMA reserves the right to make reasonable alterations to the type of facilities, programs, services, hours of operation and classes provided without notice. This covers unforeseen circumstances where qualified instructors become unavailable due to illness, injury and/or personal circumstances, and when suitably qualified substitute instructors are also unavailable. Membership fees will not be reduced due to these circumstances. CKMA will not be liable for any inconvenience caused to the participant.
9. Public Holidays and Seasonal Closures:
- Please be advised that CKMA does not host classes on Public Holidays, nor on the weekends of Public Holidays that fall on a Monday or Friday. Membership fees remain unchanged despite Public Holiday closures. Additionally, CKMA may observe a closure of two weeks or more during the Christmas period, during which regular membership payments will be temporarily halted. The exact dates of the Christmas Closure will be communicated well in advance to all participants.
10. Insurance and Injury Protocol:
- While CKMA prioritises safety during training, injuries may occur. Participants are encouraged to report any injuries to CKMA staff immediately to complete an injury report.
- Participants are advised to seek medical clearance from a certified medical practitioner following any significant injury before resuming training at CKMA.
- CKMA maintains martial arts personal accident insurance for training in timetabled self-defence and martial arts classes under supervision. This coverage does not extend to competitions, events, open mats, or activities at another venue.
- It's the participant's responsibility to contact CKMA and request insurance cover. In the event that a participant requests insurance coverage and the claim is not covered under CKMA's martial arts personal accident insurance, CKMA will notify the participant in writing explaining the reason for the denial and suggesting alternative actions the participant may wish to take.
- It is advisable for participants to maintain personal insurance coverage to complement the coverage provided by CKMA.
11. Emergencies:
- In case of an emergency, CKMA instructors will take charge and follow the emergency response procedures, ensuring the safety and well-being of all participants and staff.
By understanding and adhering to the guidelines surrounding the facilities and services, participants can enjoy a positive and structured environment for their martial arts training at CKMA.
9. Termination of Membership
CKMA reserves the right to terminate the membership of any participant with immediate effect under the following circumstances:
- Violation of the CKMA Code of Conduct.
- Membership payment fees being overdue by more than 28 days with no resolution attempts.
- Or at CKMA's sole discretion.
Should a participant’s membership be terminated due to any of the aforementioned reasons, the termination will take effect immediately, and the participant will be informed via email.
To maintain membership, participants must ensure their payments are current and must adhere to the CKMA Code of Conduct.
10. Privacy Policy

11 Provisions for Minors
- All minors participating in CKMA programs must have the consent of a parent or legal guardian. By providing consent, parents or guardians acknowledge the inherent risks involved in martial arts training at CKMA and agree to the terms and conditions stipulated for their minor.
12. Amendment Clause
- CKMA reserves the right to amend the terms and conditions of this agreement without notice. In the event of significant amendments, CKMA will notify the Participant via email with a notice period of 28 days prior to the amendments taking effect.
13. Summary of Agreements and Acknowledgements
Indemnification:
- I agree to indemnify Champions Krav Maga Academy (CKMA) including its proprietors, agents, officers, instructors, staff members, and students against any loss or damage suffered in connection with my participation in the training.
Liability Release:
- I release CKMA from any liability whatsoever in connection with my participation in the physical activities and exercises within CKMA training programs. This release shall bind me, my spouse, my heirs, my personal representatives, my assigns, my children, and my and their agents.
Media Consent:
- I consent to CKMA taking photographs and videos of classes for promotional use and release and indemnify CKMA from any claims relating to the photographs and/or videos taken of me during class.
Waiver of Claims:
- By consenting to these terms and conditions, I waive any claim against CKMA for any injuries that arise from my participation in any activities at CKMA.
Parent/Guardian Consent (if applicable):
- If I am the parent or legal guardian of the participant, I consent to the minor’s participation and agree to the above-mentioned indemnification, liability release, media consent, and waiver of claims on behalf of the minor.
By signing this document, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined in this document, and if applicable, provide consent as the parent or guardian of the minor participant.
